Welcome to élosy.

These Terms & Conditions ("Terms") govern your access to and use of the élosy website, including all purchases made through www.elosyatelier.com (the "Website").

The Website is operated by ELOSY ATELIER S.R.L., a company incorporated under the laws of Romania, with the registered details published in our Legal Notice. Throughout these Terms, "élosy", "we", "our" and "us" refer to ELOSY ATELIER S.R.L., while "you" and "your" refer to any visitor, customer or user of the Website.

By accessing our Website or placing an order, you acknowledge that you have read, understood and agreed to be bound by these Terms.

These Terms are governed by Romanian law while respecting the mandatory consumer protection rights granted under applicable European Union legislation.

1. About élosy

Every élosy piece is handcrafted in our family atelier in Sibiu, Romania.

We work exclusively with carefully selected reclaimed leather sourced through long-standing relationships. Because these materials exist in finite quantities and cannot be reordered through conventional supply chains, every collection is produced as a limited series. Once a particular leather batch has been fully used, that collection cannot be reproduced.

Natural variations in colour, grain, texture, markings and other characteristics are inherent to genuine reclaimed leather. They are not defects but part of the individuality of each piece.

No two collections—and often no two bags—are ever completely identical.

2. Eligibility

By placing an order through our Website, you confirm that:

• you are at least 18 years of age or otherwise legally capable of entering into binding contracts under the laws applicable to you;

• the information you provide is accurate and complete;

• you are purchasing products for lawful purposes only.

We reserve the right to refuse service where we reasonably believe these conditions have not been met.

3. Products

Every product is individually handcrafted.

Due to the nature of reclaimed leather and handcrafted production, slight variations between products are expected and form part of the character of the finished piece.

Product photographs are intended to represent our products as accurately as possible. However, colours, textures and finishes may appear differently depending on lighting conditions, photography and individual display settings. The appearance of reclaimed leather may also vary naturally between individual pieces.

These natural variations shall not constitute defects.

Product dimensions are approximate and may vary slightly due to the handmade nature of production.

4. Limited Series

Our collections are intentionally produced in limited series.

Unlike traditional production based on continuously available materials, each élosy collection is created using a finite allocation of reclaimed leather. Once a leather batch has been exhausted, it cannot be reproduced.

For this reason:

• products may become permanently unavailable without notice;

• future collections may differ from previous collections;

• we are unable to remake discontinued products in the same leather once the original material has been fully used.

Availability displayed on the Website does not guarantee future availability.

5. Product Information

We make every reasonable effort to ensure that product descriptions, specifications, pricing and photographs are accurate.

Occasionally, errors may occur.

We reserve the right to correct any typographical errors, inaccuracies or omissions at any time, including after an order has been submitted.

Such corrections may include:

• pricing;

• product descriptions;

• specifications;

• availability;

• photographs;

• delivery information.

6. Prices

Unless otherwise stated, all prices displayed on the Website are expressed in Euro (EUR).

Prices include VAT where applicable.

For eligible international destinations, orders are shipped Delivered Duty Paid (DDP). Where DDP is offered, applicable duties and import taxes are collected during checkout, allowing customers to pay a single final price without additional customs charges upon delivery.

Should legal or tax requirements change after purchase, we reserve the right to comply with applicable legislation.

7. Payment

We accept the payment methods displayed during checkout.

Payment must be successfully authorised before an order can be processed.

If payment cannot be authorised or is subsequently reversed, we reserve the right to suspend or cancel the order.

Title to the products shall remain with élosy until payment has been received in full.

Risk passes to you upon delivery.

8. Placing an Order

Submitting an order constitutes an offer to purchase the selected products.

After placing your order, you will receive an automatic confirmation email acknowledging receipt of your order.

This acknowledgement does not constitute acceptance of your order.

A binding contract is formed only once your order has been reviewed, accepted and dispatched by élosy.

We reserve the right to refuse or cancel any order prior to dispatch, including but not limited to circumstances involving:

• pricing errors;

• inventory discrepancies;

• suspected fraud;

• suspected unauthorised payment;

• export restrictions;

• technical errors;

• circumstances beyond our reasonable control.

Where payment has already been collected for a cancelled order, it will be refunded using the original payment method.

9. Availability

Every product is subject to availability.

Because each collection is produced from reclaimed leather available only in finite quantities, inventory is inherently limited.

Although we make every effort to maintain accurate stock levels, inventory discrepancies may occasionally occur.

Where a purchased item is no longer available, we may:

• cancel the order;

• partially fulfil the order where appropriate;

• issue a full refund for unavailable products.

We shall not be liable for products becoming permanently unavailable after sale.

10. Shipping

Shipping destinations, delivery estimates and available services are described in our Shipping Policy, which forms part of these Terms.

Orders are shipped exclusively through DHL.

Estimated delivery times are provided for guidance only and do not constitute guaranteed delivery dates.

We are not responsible for delays caused by:

• customs authorities;

• weather;

• carrier disruptions;

• force majeure events;

• public holidays;

• inaccurate delivery information supplied by the customer.

Ownership of the products transfers upon delivery.

Risk of loss or damage passes to the customer once delivery has been completed.

11. Right of Withdrawal

If you are purchasing as a consumer, you may withdraw from your purchase within thirty (30) calendar days from the date on which you or a person designated by you receives the products.

This voluntary 30-day return period offered by élosy exceeds the statutory withdrawal period provided under applicable European consumer legislation.

To exercise your right of withdrawal, you must contact us before the expiry of the return period.

Returns may only be made using a DHL return label issued by élosy.

For security, insurance and customs reasons, independently arranged return shipments may be refused.

Return shipping costs are the responsibility of the customer and will be deducted from the refund.

Returned products must:

• be unused except to the extent reasonably necessary to inspect them;

• show no signs of wear beyond such inspection;

• be returned with the original dust bag, packaging, care card and any included accessories;

• be packaged securely to prevent damage during transport.

After receiving the returned item, we will inspect it before approving the refund.

If a returned item has been handled beyond what is reasonably necessary to determine its nature, characteristics or functionality, we reserve the right to reduce the refund proportionately to reflect the resulting loss in value or, where appropriate, refuse the return.

Approved refunds are processed within fourteen (14) days after inspection using the original payment method.

Any original shipping charges are non-refundable unless required by applicable law.

Customised or personalised products, where offered, are not eligible for withdrawal unless required by law.

12. Lifetime Craftsmanship Promise

At élosy, we believe that exceptional craftsmanship should endure.

Every bag is handcrafted in our family atelier in Sibiu, Romania with the intention of being carried, enjoyed and cared for over many years. We proudly stand behind the quality of our work through our Lifetime Craftsmanship Promise.

If your bag develops a defect resulting from the way it was made, we will repair it on a complimentary basis for the lifetime of the product.

A craftsmanship defect refers to a failure arising from the manufacture or assembly of the product under normal intended use. This may include, where applicable:

• stitching that comes undone due to defective workmanship;

• structural construction failures;

• detached or defective hardware;

• edge finishing that fails due to improper application;

• defects in assembly affecting the normal function of the product.

Each repair request is individually assessed by our atelier.

To request a repair, please contact us at hello@elosyatelier.com with photographs of the product and a description of the issue. If additional inspection is required, we may ask you to send the product to our atelier.

While repairs covered by this Promise are carried out free of charge, shipping to and from our atelier remains the customer's responsibility.

The Lifetime Craftsmanship Promise is offered in addition to, and does not affect, your statutory legal rights under applicable consumer protection laws.

13. Care & Restoration

Leather is a natural material that evolves with use.

Over time, your bag will develop a patina, soften in certain areas and display signs of a life well lived. These changes are expected characteristics of genuine reclaimed leather and should not be considered defects.

Our complimentary Lifetime Craftsmanship Promise does not cover:

• normal wear and tear;

• natural ageing of leather;

• scratches;

• scuffs;

• stains;

• ink marks;

• water damage;

• exposure to excessive heat or sunlight;

• colour transfer from clothing or other materials;

• misuse or neglect;

• accidental damage;

• damage caused by pets;

• damage resulting from improper storage or cleaning;

• modifications or repairs carried out by third parties.

This list is not exhaustive.

If your bag requires repair for reasons not covered by the Lifetime Craftsmanship Promise, we will always do our best to help.

Where restoration is possible, we will provide a quotation before commencing any work. Repairs outside the scope of the Promise are charged at cost, together with the applicable shipping charges.

As every repair is unique, pricing and repair times are determined on a case-by-case basis.

14. The Preloved Programme

We believe that exceptional craftsmanship deserves more than one life.

When your élosy bag reaches the end of its journey with you, you may choose to return it to us through our Preloved Programme.

Returned bags become the property of élosy.

Where suitable, we will carefully restore them in our atelier before offering them for sale through our dedicated Preloved collection.

As a thank you for participating in our circular programme, you will receive a 20% discount towards a future purchase on our Website, subject to the terms of the programme in force at the time of return.

Acceptance into the Preloved Programme is at our sole discretion.

We reserve the right to decline products that cannot reasonably be restored, authenticated or resold.

The discount issued through the Preloved Programme has no cash value, is non-transferable and may not be exchanged for cash unless required by law.

15. Intellectual Property

Unless otherwise stated, all content made available on the Website is owned by or licensed to élosy.

This includes, without limitation:

• product designs;

• photographs;

• videos;

• editorial imagery;

• graphics;

• logos;

• trademarks;

• product names;

• illustrations;

• written content;

• website design;

• layout and visual identity.

These materials are protected under Romanian, European Union and international intellectual property laws.

No part of the Website may be copied, reproduced, distributed, modified, published, sold, licensed or otherwise exploited without our prior written permission.

Nothing contained on the Website grants any licence or right to use our intellectual property except as expressly permitted by law.

16. Artificial Intelligence & Automated Access

The content published on this Website reflects the creative work of élosy and its collaborators.

Without our prior written consent, you may not:

• scrape or systematically extract content from the Website;

• use automated tools to collect product information or images;

• use our photographs, editorial content, designs or written materials for the training, development or improvement of artificial intelligence or machine learning systems;

• create datasets incorporating our content;

• reproduce our designs for commercial purposes.

We reserve all rights available under applicable intellectual property laws.

17. Acceptable Use

You agree not to use the Website in any manner that:

• violates applicable law;

• infringes the rights of others;

• introduces malicious software or code;

• interferes with the security or operation of the Website;

• attempts unauthorised access to our systems;

• engages in fraudulent activity.

We reserve the right to suspend or restrict access where such conduct is reasonably suspected.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability where such limitation would be unlawful.

To the maximum extent permitted by applicable law, élosy shall not be liable for indirect, incidental, special or consequential damages arising from the use of the Website or the purchase of our products.

Our total liability relating to any order shall not exceed the amount paid for the relevant product, except where mandatory law provides otherwise.

Nothing in these Terms limits your statutory rights as a consumer.

19. Privacy

Your privacy is important to us.

The way we collect, use and protect your personal information is described in our Privacy Policy, which forms part of these Terms.

By using our Website, you acknowledge that your personal data may be processed in accordance with that Policy.

20. Force Majeure

We shall not be responsible for any failure or delay in performing our obligations where such failure results from circumstances beyond our reasonable control.

These circumstances may include, without limitation:

• natural disasters;

• war;

• terrorism;

• strikes;

• governmental measures;

• epidemics or pandemics;

• interruptions affecting transport providers;

• failures of communication networks;

• supplier disruptions beyond our reasonable control.

Where such circumstances continue for an extended period, we reserve the right to suspend or cancel affected orders.

21. Governing Law

These Terms are governed by and interpreted in accordance with the laws of Romania.

If you are a consumer residing in another Member State of the European Union, you continue to benefit from any mandatory consumer protection provisions applicable in your country of residence.

Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Romania, unless mandatory law provides otherwise.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, legal obligations or the operation of the Website.

The version published on the Website at the time of your purchase shall apply to your order.

We encourage you to review these Terms periodically.
